Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Truely Sell platform, available at truelysell.pro and through our mobile applications (together, the "Platform"). The Platform is operated by StoresWiki LLC, Via Giuseppe Mazzini 4, Belpasso, 95032, CT, Italia ("Truely Sell", "we", "us" or "our"). By accessing or using the Platform you agree to be bound by these Terms. If you do not agree, please do not use the Platform.
1. Definitions
- User — any person who accesses or uses the Platform, including Customers and Providers.
- Customer — a User who books or purchases services through the Platform.
- Provider — an independent professional or business that lists and delivers services through the Platform.
- Service — any service offered by a Provider and booked through the Platform.
- Booking — a confirmed order for a Service between a Customer and a Provider.
2. The role of Truely Sell
Truely Sell is a marketplace that connects Customers with independent Providers. We are not the provider of the Services listed and we do not employ Providers. The contract for any Service is formed directly between the Customer and the Provider. We are not a party to that contract and are not responsible for the performance, quality, timing or legality of any Service. We facilitate discovery, booking, communication and payment, and we work to keep the marketplace fair and safe.
3. Eligibility and accounts
You must be at least 18 years old and able to enter into a binding contract to use the Platform. You agree to provide accurate, current and complete information when you register and to keep it up to date. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. Notify us immediately of any unauthorised use.
4. Bookings
When a Customer places a Booking, the Customer makes an offer to purchase the selected Service on the terms shown at checkout. A Booking is confirmed when the Provider accepts it and the Customer receives confirmation. Providers are responsible for the accuracy of their listings, pricing, availability and the lawful delivery of their Services.
5. Pricing, payments and commission
- Service prices are set by Providers and shown before checkout. Applicable taxes and platform fees are displayed at the time of Booking.
- Payments are processed through third-party payment providers. By making a payment you agree to the applicable processor's terms. We do not store full card details.
- Truely Sell charges Providers a commission on completed Bookings and may offer optional paid membership plans and promotional placements. The applicable commission and plan terms are presented to Providers in their dashboard.
6. Cancellations and refunds
Cancellation and refund eligibility depends on the Provider's stated policy for the Service, the timing of the cancellation and the status of the Booking:
- Customer cancellation — Customers may cancel a Booking before the Service begins, subject to the Provider's cancellation window. Refunds for eligible cancellations are returned to the original payment method.
- Provider cancellation — if a Provider cancels a confirmed Booking, the Customer is entitled to a full refund of amounts paid for that Booking.
- Disputes — if a Service is not delivered as described, the Customer may open a dispute through the Platform. We will review the evidence from both parties and may, at our discretion, facilitate a partial or full refund.
- Refund timing depends on the payment processor and the Customer's bank, and is typically completed within 5–10 business days of approval.
Nothing in this section limits any mandatory consumer rights you may have under applicable law, including the right of withdrawal where it applies.
7. User conduct
You agree not to use the Platform to: post false, misleading or unlawful content; infringe the rights of others; circumvent the Platform to avoid fees; transmit malware; harass, threaten or defraud any person; or take any action that disrupts the integrity or security of the Platform. We may remove content and suspend or terminate accounts that breach these Terms.
8. Reviews and content
Reviews must reflect genuine experiences. You retain ownership of the content you submit but grant Truely Sell a non-exclusive, worldwide, royalty-free licence to host, display and use that content to operate and promote the Platform. We may moderate or remove content that violates these Terms.
9. Intellectual property
The Platform, including its software, design, trademarks and content (excluding User-submitted content), is owned by StoresWiki LLC or its licensors and is protected by intellectual property laws. You may not copy, modify, distribute or create derivative works without our prior written consent.
10. Disclaimers
The Platform is provided on an "as is" and "as available" basis. We do not warrant that the Platform will be uninterrupted, error-free or secure, and we make no warranty regarding the conduct of Users or the quality of any Service. Providers are solely responsible for the Services they deliver.
11. Limitation of liability
To the maximum extent permitted by law, StoresWiki LLC shall not be liable for any indirect, incidental, special or consequential damages, or for any loss of profit, data or goodwill, arising from your use of the Platform or any Service. Our aggregate liability for any claim relating to the Platform shall not exceed the total fees we received in connection with the Booking giving rise to the claim.
12. Indemnity
You agree to indemnify and hold harmless StoresWiki LLC and its officers, employees and agents from any claim or demand arising out of your use of the Platform, your content, or your breach of these Terms or of any applicable law.
13. Suspension and termination
We may suspend or terminate your access to the Platform at any time if you breach these Terms or if we are required to do so by law. You may close your account at any time. Provisions that by their nature should survive termination will continue to apply.
14. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified through the Platform or by email. Your continued use of the Platform after changes take effect constitutes acceptance of the revised Terms.
15. Governing law and jurisdiction
These Terms are governed by the laws of Italy. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts of Catania (CT), Italy, without prejudice to any mandatory consumer-protection rights that entitle a consumer to bring proceedings in their place of residence.
